By participating in this charity event, customers (the "Donor(s)") agree to the following terms and conditions:

Purpose of the Event:
The purpose of this event is to allow customers to make a monetary donation towards the purchase of items that will be included in gift bags for donation to children in need. The items to be donated will come from the inventory of The Poké Court, which will be used to assemble the gift bags. These bags will then be donated to the Metro New York chapter of Make-a-Wish for children awaiting wishes and other local charities who will distribute the boxes as holiday gifts to kids in need in the New York area. -
Nature of the Contribution:
Customers understand and agree that by participating in this event, they are making a financial donation to cover the cost of an item from The Poké Court’s inventory that will be included in the charitable gift bags. Customers are not purchasing products for personal use, nor will they receive any physical products. The donated items will remain the property of The Poké Court until they are included in the charity gift bags and distributed to the intended recipients. -
100% of Proceeds Donated:
All proceeds from the donations will be used to cover the costs of the items donated from the The Poké Court’s inventory, as well as any associated costs. The Poké Court is organizing this event with the intention of supporting a charitable cause, and will ensure that all funds raised are used exclusively for charitable purposes. -
Tax Deductibility of Donations:
Donations made in this event are not tax-deductible. The donation is to be considered a charitable gift, not a purchase. The Poké Court will not be receiving any tax deductions from this charitable event. -
Event Delay or Cancellation:
The Organizer reserves the right to modify, suspend, or cancel the event at any time, including in the event of unforeseen circumstances or legal requirements. If the event is canceled, The Poké Court will make reasonable efforts to ensure that all funds and items raised are directed toward the charity and used in a manner consistent with the event's purpose. -
Liability and Indemnification:
By participating in this event, the Donor agrees to indemnify, defend, and hold harmless The Poké Court, its affiliates, employees, agents, and representatives from any and all liabilities, losses, claims, or damages arising from participation in this charitable donation event. -
No Refund Policy:
As this is a charitable donation event, all contributions are final and non-refundable. Once a donation is made, no refunds, returns, or exchanges will be processed. -
Charity Partner:
The gift bags created with the donated items will be given to the New York Metro chapter of Make-a-Wish, a registered nonprofit organization, and other local charities for distribution to children in need. The Poké Court will ensure that all donations are used to benefit the designated cause, and will provide transparency on how the funds and items are being allocated upon request.
